Anton Piller Orders
and the
Federal Court of Canada
by
Daniel S. Drapeau and Jonathan J. Cullen
2008 marks the 25th anniversary of the issuance of the first Anton Piller Order by the Federal Court of Canada. During this period, the Federal Court has developed an impressive corpus of jurisprudence with respect to both Anton Piller and John Doe Orders, adopting along the way an increasingly watchful approach. The aim of this book is to provide those interested in this type of remedy with a roadmap of the Federal Court’s jurisprudence on this topic. The book answers questions such as:
- What are the conditions that one must establish to obtain an Anton Piller Order?
- What are the presumptions from which a plaintiff can benefit?
- What are the do’s and don’ts of executing an Anton Piller Order?
- How to prepare for the Court’s review of the execution?
