Learning Objectives
- Determine what constitutes proper evidence and what is
inadmissible evidence.
- Ascertain the significance to be given to admissible evidence.
- Interpret the rules governing the admissibility of evidence,
such as relevance, hearsay and prejudice, and when and how
to object to the admissibility of evidence.
- Assess the proper use of particular types of evidence
that can be filed, such as demonstrative evidence, expert
evidence, reply evidence and survey evidence.
- Identify strategies for introducing evidence into court
proceedings, before the Patent Appeal Board, the Trade-marks
Opposition Board and other tribunals.
- Prepare affidavit evidence and strategies for effective
cross-examination on affidavits.
