
Take an in-depth look at a number of trade-mark issues that may or may not be encountered on a daily basis: official marks, plant
breeders’ rights marks, geographical indications, non-traditional marks, Distinguishing Guises and certification marks. You will also
explore some more detailed issues with respect to licensing, assignments and other amendments to the Register, and associated marks.
Curriculum
- Official Marks – filing, who can be public authority, test for confusion,
challenging an official mark
- Prohibited Marks – generic marks, obscene/immoral marks, portraits/
signatures/connection with living individual
- Plant Breeders Rights Marks – criteria, publication, objections
- Geographical Indications and indications for wines & spirits – legal
effect, agreement with EU, statement of objection
- Certification Marks – definition, standards, use requirement
- Non-traditional Marks – motion & hologram marks (new Practice
Notice); colour, sounds, scents, series marks; shapes & Distinguishing
Guises
- Assignments – preparation, recording of assignments, recordals of
other chains in title, association and dissassociation of marks
- Licensing Issues – preparation, use by licensee, oral licenses,
establishing control
Who
should participate
Trade-mark agent trainees (1 year minimum experience),
trade-mark agents (beginner to mid-level experience), in-house counsel, paralegals, trade-mark portfolio managers.
Course format
This online course includes: reading material, practical exercises (Q&A),
caselaw, assignments and past trade-mark agent exams. Assignments
will be reviewed weekly by instructors who will remain accessible
throughout the course. Students and instructors will participate in a
web-based discussion forum. The course will break from the week of
May 16, 2011 to facilitate participation in the INTA meeting.
