This Patent Agent Training Course is an advanced, practical program intended to enhance the patent agent trainees’ skills relevant to infringement and validity and to increase their chances of success in the Patent Agent Qualifying Examination.

The delivery of this course is a combination of in-class and distance education learning.


An initial 3-day classroom session will be held to introduce the core principles surrounding patent infringement and validity:

  • Review of relevant jurisprudence

  • Claim construction and interpretation

  • Basis for infringement and remedies

  • Limitation periods

  • Essential v. non-essential elements

  • Direct v. indirect infringement

  • Defenses to infringement

  • Presumption of validity

  • Anticipation/novelty

  • Inventive step/obviousness

  • Utility

  • Sufficiency of description/ambiguity

  • Inventorship

Exam Preparation – former Patent Agent Exam Board Members will address the class on preparing for Papers B and D of the examination.

Attendance at the session in mandatory.


The initial session will be followed by 8 weeks of practice exercises, consisting of one exercise per week (February 3 - March 28, 2014). The homework will involve approximately 5 hours per week. The exercises will be submitted via e-mail to the instructors who will in turn provide comprehensive feedback on each answer received.
