Witmart Inc. is seeking a Certified Canadian Trademark Agent with a minimum of two years’ experience, based in Toronto, ON. As a Canadian Trademark Agent at Witmart, you will work in a fast-paced and innovative environment to make trademarking services available and affordable to businesses at all development stages. You will be the trademark expert and the go-to person for all trademark related matters. You’ll also be part of a smart and highly ambitious team that embraces changes and challenges to constantly improve trademark processes and services.

The key responsibilities of the Canadian Trademark Agent include, but are not limited to: reviewing and managing trademark searches, filing, responding to office actions, and responding to trademark oppositions. In this role, you will use your professional knowledge of trademark law to provide professional advice, and identify/evaluate potential risks for all Witmart's clients.

Key Responsibilities

  • Review and manage all trademark-related operations.
  • Work and mentor a team of trademark paralegals in trademark searches, filing, and respond to office actions and oppositions.
  • Draft and review all trademark-related documents to achieve the maximum success rate on trademark applications.
  • Support and provide how-to training for trademark consultants on basic trademark knowledge and related areas.
  • Learn and understand the full internal trademark filing process and propose optimization strategies for both compliance and efficiency.
  • Develop, manage and work with outside trademark attorneys and agents on jurisdictions outside of Canada to help our clients secure and protect their brand worldwide.
  • Be the expert and go-to person for all things related to trademarking in Canada and be willing to learn about other jurisdictions that use English such as the U.S. and EU.
  • Collaborate with product and operation teams to contribute trademark-related content for our website, marketing materials and other offline content.
  • Represent Witmart by attending and presenting in trademark-related events and seminars.
  • May require some travel for out of province or out of country trade shows and events


  • Certified Canadian Trademark Agent
  • Experience working with an US attorney to represent non-Canadian trademark applicants before the USPTO is a plus
  • 2 years of experience practicing before CIPO
  • Ability to work in a fast-paced environment, while effectively shifting priorities to manage multiple projects.
  • Knowledge and ability to identify and handle complex issues in many disciplines, with expertise in intellectual property.
  • Ability to work independently and collaboratively with cross-functional teams.
  • Excellent communication, interpersonal skills, and project management skills.
  • Demonstrated attention to detail and problem-solving ability.
  • Desire to learn additional areas of IP law.
  • Certified patent agent, or thorough understand of patent fillings will be a plus
