In late November, the Supreme Court of Canada issued reasons in the closely watched case of Canadian Broadcasting Corp. v. SODRAC 2003 Inc., 2015 SCC 57. This landmark decision on technological neutrality and the copyright balance is likely to impact the courts’ and the Copyright Board’s interpretation of the existence of copyrights as well as the valuation of rights at the Board level for years to come.
